It looks like he's the background, with a rain cap on, standing with his hand on his hip, in front of the man under the umbrella. Im guessing this shot is from The Prizefighter and the Lady 1933.
That doesn't look like Mad Cap Max Baer to me. Dont want to quibble though. Max Baer was really cool! and he was good in 'The Prizefighter and the Lady' Max Baer knocked out at least fifty opponants and when he knock them out they stayed knocked out! Too bad he really wasn't dedicated to boxing.

I'm not 100 percent sure on that being Max Baer. It sounds like your a Baer fan, so I'll defer to your expertise and edit for accuracy.
